Terms and Conditions Purchase NEBOSH IIRSM Certificate In Risk Management
1. GENERAL DEFINITIONS
(a) “SDSTC Ltd” means ‘16 Degree Shift Training and Consultancy Ltd’, Royal Quays Business Centre, Coble Dene, North Shields Newcastle upon Tyne NE29 6DE.
(b) ‘Client’ means the person(s) and/or the organisation booking / purchasing the ‘NEBOSH IIRSM Certificate in Managing Risk’
(c) ‘Training Course’ refers to the training courses purchased as above
(d) ‘Learner’ refers to any person purchasing the training course. ‘Learner’ is synonymous with student, candidate or delegate.
(e) ‘eLearning’ or ‘Remote Learning’ – Where a learner receives login details and progresses their learning via the NEBOSH online platform.
(f) ‘Login details’ refers to those released directly from NEBOSH to gain access to NEBOSH’s eLearning platform.
2. PROVISION OF SERVICES
(a) SDSTC Ltd shall register the Client on the NEBOSH CPI upon Client’s completion of the online booking form, registration form and successful payment. Learners to state when they want their 90 days to start on their booking form.
(b) Learner’s place(s) on the course are not confirmed until payment is received.
(c) Upon receipt of payment – The learner will be registered with NEBOSH for this course and will then receive log in details for the NEBOSH eLearning platform directly from NEBOSH.
(d) Tutor support is available upon request and will be provided in a manor deemed appropriate by SDST Ltd based on learner numbers and Tutor availability. This may take any form such as phone, email or study workshops online or in person, 1-2-1, small or large groups. This support shall be provided within a reasonable time and you will be notified of support arrangement if you have requested support. Tutor support will be limited to max 4 hours per learner. You do not need to request any support if you do not need it.
(e) For any changes or cancellations see Article 5 below.
3. OBLIGATIONS OF CLIENT
(a) Provide any additional information to SDSTC Ltd regarding specific learning needs (e.g. dyslexia) by email at the time of booking.
(b) Ensure a suitable internet connection to ensure uninterrupted participation in training.
(c) Follow all instructions and ground rules given by NEBOSH – do be familiar with their policy on malpractice available on their website.
(d) Contact SDSTC ltd on info@sdst.co.uk as the first point of contact for any issues or support requests.
(e) Complete the course and pass the assessment within 90 days of logging on to the NEBOSH eLearning system.
(f) Access and save their own certificate upon successful completion of the course.
(g) In the event of two unsuccessful attempts at the final assessment, the learner has the option to pay additional fees as detailed below to be registered for a resit.
4. FEES AND PAYMENT
(a) The Client shall make payment to SDSTC Ltd as instructed – either by BACS transfer as detailed on invoice or via Online/Stripe payment Link.
(b) When full payment has been received by SDSTC Ltd, The Client will be registered on the NEBOSH Exam System (CPI). The Client will then
receive log in details approximately 10 – 14 days from receipt of payment.
(c) Following two unsuccessful attempts on the final online assessment additional fees of £195 + VAT are chargeable should the candidate wish to have a further attempt. Payment must be received by SDSTC Ltd prior to re-registering for additional attempts.
5. CANCELLATION AND REFUNDS
(a) No refunds shall be issued if:
(i) SDSTC Ltd is unable to perform all or part of the Services for any cause whatsoever outside SDSTC Ltd’s control.
(ii) The Learner fails to use their log in details, fails to comply with their obligations in Article 3 above or fails to achieve a ‘pass’ in the online 1-hour assessment two times in a row.
(iii) The learner does not complete the course within 90 days of receiving their log in details.
(iv) SDSTC Ltd has already registered the learner on the CPI.
6. CONFIDENTIALITY
(a) As used herein, “Confidential Information” shall include the Client’s Information and any information oral or written that a party may acquire
from the other party pursuant to the Services provided, however, that Confidential Information shall not include any information which (1) is or
hereafter becomes generally known to the public; (2) was available to the receiving party on a non-confidential basis prior to the time of its
disclosure by the disclosing party; (3) is disclosed by an independent third party with a right to make such disclosure.
(b) Unless required by law, neither party shall disclose the other’s Confidential Information to any person nor entity, except as expressly
provided for herein.
(c) SDSTC Ltd has the right to make and retain copies of training records and associated evidence collated during the provision of the Services
for the purposes of assessment, certification and SDSTC Ltd’s own records.
(d) SDSTC Ltd will handle any personal information appropriately and comply with applicable privacy laws
7. MISCELLANEOUS
(a) If any one or more provisions of these Terms and Conditions are found to be illegal or unenforceable in any respect, the validity, legality and
enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
(b) Use of SDSTC Ltd’s corporate name or registered marks for advertising purposes is not permitted without the SDSTC Ltd’s prior written
authorisation.
(C) Any training materials are considered to be the intellectual property of NEBOSH and must not to be duplicate or used by the Client for their
own purposes without the express written consent of SDSTC Ltd.
8. GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION
THIS AGREEMENT, consisting of the quotation and these terms and conditions, shall be governed by English Law and both parties submit to
the exclusive jurisdiction of the courts of England and Wales.
